Welcome to the websites www.bukhashbrothers.com, www.abtalks.ae and shop.abtalks.ae (the “Websites”), as well as the digital platforms and services operated by Bukhash Brothers, including its media segment #ABtalks. By accessing or using our Websites, services, or engaging with our creative, media, or e-commerce offerings, you acknowledge and agree to be bound by these Terms and Conditions (the “Terms”).

Bukhash Brothers is a Dubai-based creative and digital agency providing branding, content, production, influencer management, and related consultancy services. #ABtalks is a media platform producing editorial content and operating an e-commerce store available at shop.abtalks.ae.

Certain provisions of these Terms apply specifically to Bukhash Brothers’ creative and digital services, others apply to #ABtalks’ media content and e-commerce activities. Unless expressly stated otherwise, all provisions apply collectively to Bukhash Brothers and its associated platforms.

If you do not agree with these Terms, you must immediately cease accessing and using the Websites, platforms, services, or shop.

1. Definitions

For the purposes of these Terms, the following definitions shall apply, unless the context requires otherwise:

“Bukhash Brothers” means Bukhash Brothers LLC, a company duly incorporated and existing under the laws of the Emirate of Dubai, United Arab Emirates, having its principal place of business at Alserkal Avenue, Warehouse 14, Al Quoz Industrial Area 1, Dubai, UAE. Bukhash Brothers operates the Websites and provides all related creative, digital, media, and e-commerce services described herein.

“#ABtalks” refers to a media and e-commerce segment operated and managed by Bukhash Brothers, dedicated to the production and distribution of editorial, audiovisual, and digital content, as well as the sale of branded products via the online store accessible at shop.abtalks.ae. #ABtalks is not a separate legal entity.

“Websites” collectively refers to the online platforms operated by Bukhash Brothers, namely www.bukhashbrothers.com, www.abtalks.ae, and shop.abtalks.ae, together with any subdomains, microsites, or other digital properties owned or controlled by Bukhash Brothers that link to these Terms.

“Services” means all creative, digital, branding, production, media, consultancy, and related offerings provided by Bukhash Brothers, including any e-commerce services made available through shop.abtalks.ae.

“Products” means all physical or digital goods offered for sale through shop.abtalks.ae, including limited-edition items, merchandise, and accessories made available under the #ABtalks brand.

“User”, “you”, or “your” means any natural person or legal entity accessing, browsing, registering on, purchasing from, or otherwise using any of the Websites or Services.

“Client” refers to any individual or organization entering into a contractual or service engagement with Bukhash Brothers for creative, digital, or consultancy services, whether on a one-off or retained basis.

“Order” means any confirmed request by a User to purchase Products through shop.abtalks.ae, whether paid or pending payment, in accordance with these Terms.

“Content” refers to all materials and elements published, displayed, or otherwise made available through the Websites or Services, including but not limited to text, designs, graphics, logos, photographs, videos, audio recordings, podcasts, software, databases, layouts, interfaces, code, and other works protected under applicable intellectual property laws.

“Privacy Policy” refers to the privacy statement available on the Websites that explains how Bukhash Brothers collects, uses, stores, and protects personal data in connection with the Services and Products.

“UAE Law” means the applicable federal laws of the United Arab Emirates and the laws of the Emirate of Dubai, including relevant executive regulations and ministerial decisions, as amended from time to time.

“Force Majeure Event” means any event or circumstance beyond the reasonable control of Bukhash Brothers, including but not limited to acts of God, fire, flood, war, pandemic, epidemic, civil disturbance, strike, governmental restriction, failure of utilities or telecommunications, or acts of third-party providers that prevent or delay the performance of obligations.

2. Acceptance and enforceability of the Terms

By accessing or using Websites operated by Bukhash Brothers, you fully and unconditionally accept these Terms and agree to comply with them. The Terms are binding from the moment of first use or engagement.

By submitting an order on shop.abtalks.ae, or by entering into a service engagement with Bukhash Brothers, you expressly confirm that you have read, understood, and agreed to these Terms.

Bukhash Brothers may amend these Terms at any time without prior notice. Updates take effect immediately upon publication online. Continued use after such changes constitutes acceptance of the updated Terms.

3. Access and use of the Websites

The Websites are accessible free of charge to any user with internet access. Users are responsible for ensuring that their equipment meets the necessary technical specifications and compatibility standards. All access and telecommunications costs remain the user’s sole responsibility.

Bukhash Brothers does not guarantee uninterrupted access to its Websites and reserves the right to suspend or restrict access at any time, particularly for maintenance or updates.

You agree not to use the Websites for fraudulent purposes or in any way that could harm the image, interests, or rights of the Bukhash Brothers or third parties. This includes introducing malware, hacking, unauthorized data access, or disrupting proper use. In the event of breach or suspected breach, Bukhash Brothers reserves the right to restrict, suspend, or terminate your access without prejudice to remedies under UAE law.

4. Registration

Certain services and related features offered through the Websites, including but not limited to newsletters, influencer engagement tools, client portals, and #ABtalks online store functionalities, may require registration or subscription to enable your use of them.

By registering or subscribing, you agree to provide complete, accurate, and up-to-date information about yourself or your organization, and to promptly update such information in case of any changes.

We may amend our registration or subscription requirements from time to time. As a registered user, you are solely responsible for maintaining the confidentiality and security of your login credentials, passwords, and other account identifiers. You accept full responsibility for all activities that occur under your account, whether authorized by you or not.

If you become aware of any unauthorized use of your password or account, you must notify us immediately. Bukhash Brothers shall not be liable, directly or indirectly, for any loss, damage, or claims arising from your failure to comply with these obligations. You may, however, be held liable for losses incurred by Bukhash Brothers, including #ABtalks, or third parties due to such unauthorized use.

5. Part I – Bukhash Brothers – Creative & digital services

5.1. Scope of services

Bukhash Brothers provides a full suite of creative and digital services, including but not limited to social media strategy and management, influencer marketing, content production, branding, creative strategy, advertising campaigns, experiential marketing, digital consultancy, and related advisory services.

The scope of services, deliverables, timelines, and fees are specified in written proposals, contracts, or agreements. Engagements with Bukhash Brothers imply acceptance of our professional methodology, creative discretion, and operational processes.

5.2. Client responsibilities and warranties

Clients must provide accurate, complete, and timely information and materials required for service delivery, including brand assets, logos, legal permissions, and approvals. Bukhash Brothers shall not be liable for delays or outcomes resulting from incomplete or inaccurate information.

Clients warrant that their materials do not infringe third-party rights and indemnify Bukhash Brothers against related claims. Clients also agree to comply with all applicable UAE laws and regulations in relation to the use of the services.

5.3. Social media and influencer engagement

Bukhash Brothers may act as a facilitator and content manager for social media and influencer campaigns. Editorial discretion is maintained to ensure compliance with UAE laws, advertising standards, and platform policies. Clients must provide timely approval of content drafts, creative concepts, and influencer contracts. Campaign results such as engagement or conversion metrics are not guaranteed. Bukhash Brothers may suspend or terminate campaigns where content or activities breach applicable laws or policies.

5.4. Content ownership and intellectual property

All intellectual property, including creative concepts, designs, videos, graphics, and deliverables, remains the property of Bukhash Brothers until full payment is received. Upon full payment, ownership rights transfer to the client for the specific agreed purpose. Bukhash Brothers retains the right to showcase work for portfolio or marketing purposes unless otherwise agreed in writing. Unauthorized reproduction or modification of content beyond the agreed scope is prohibited.

The content of the Websites, including software, text, graphics, videos, and logos, is protected under intellectual property law. Any total or partial reproduction without prior written consent from Bukhash Brothers is prohibited. The trademarks and domain names displayed on the Websites are also legally protected and may not be reproduced without authorization.

5.5. Third-party websites

The Websites may contain links to third-party websites or social networks. Bukhash Brothers cannot be held liable for the content, terms of use, or privacy policies of such websites. Accessing third-party websites is at your own risk and subject to their own terms and conditions. The existence of links does not imply endorsement by Bukhash Brothers.

5.6. Fees, payment terms, and third-party costs

Service fees, media buying costs, influencer payments, production expenses, and any third-party costs are specified in proposals or agreements. Fees are exclusive of VAT or applicable taxes unless otherwise stated. Late payments may result in suspension of services or accrue interest as permitted under UAE law.

5.7. Confidentiality

Both Bukhash Brothers and its clients must maintain the confidentiality of non-public information shared during engagements. Obligations survive termination. Exceptions apply where disclosure is required under UAE law.

5.8. Campaign execution and approval

Campaigns are executed according to approved briefs and plans. Bukhash Brothers is not liable for delays resulting from client inaction. While professional expertise is applied, campaign outcomes are not guaranteed.

6. Part II – #ABtalks media content

#ABtalks produces and distributes editorial and media content, including interviews, podcasts, and digital videos. Content is for informational and entertainment purposes only and does not constitute advice.

No content may be reproduced, adapted, or exploited without prior written authorization. Limited sharing through embedding or linking in accordance with fair use is permitted, provided attribution is maintained.

7. Part III – #ABtalks e-commerce (shop.abtalks.ae)

7.1. Products and pricing

Products offered for sale on shop.abtalks.ae are described and presented as accurately as possible. However, we do not guarantee that descriptions, images, specifications, pricing, or availability are error-free. All products are subject to acceptance and availability at the time of order.

If, following the placement of an order, a product cannot be supplied for any reason, we will notify you promptly, cancel the affected part of your order, and refund any amounts already paid for the unavailable product. We reserve the right to refuse or cancel any order in circumstances including, but not limited to, inaccuracies or errors in product or pricing information, inability to obtain payment authorization, or applicable shipping restrictions.

In the event of a pricing error, we will inform you as soon as possible. We are under no obligation to fulfill an order at an incorrect price. If you have already paid, a refund will be issued to you, or your account will be re-credited accordingly.

All prices are listed in UAE Dirhams (AED) and may include VAT where applicable. By confirming your purchase at the end of the checkout process, you agree to pay the total price stated in your order, including any delivery charges.

7.2. Orders and payments

Once you place an order, you will receive an acknowledgment email confirming receipt of your order details. This email does not constitute acceptance of your order. Acceptance occurs only when your order has been packed and dispatched, at which point you will receive a dispatch confirmation email. At this stage, the sale contract is concluded in Dubai, United Arab Emirates, and the language of the contract is English.

#ABtalks reserves the right to refuse or cancel any order in the event of errors, suspected fraud, unavailability of products, or issues identified with payment authorization.

Payments are processed via secure third-party gateways and are subject to the terms and conditions of banks and payment providers. All payments are processed securely, and Bukhash Brothers does not store or have access to customers’ full payment card details.

7.3. Shipping and delivery

Orders are shipped both within the UAE and internationally, subject to the availability of shipping services. Delivery times are provided as estimates only and may vary due to factors beyond our control, including courier delays and customs clearance procedures.

For international orders, customers are solely responsible for the payment of any applicable customs duties, import taxes, or related charges.

7.4. Returns and refunds

Returns and refunds are managed in accordance with the UAE Consumer Protection Law. Products may be returned only if they are unused, in their original packaging, and within the stated return period communicated on the Websites at the time of purchase.

Refunds, when applicable, will be processed through the same method of payment originally used for purchase.

7.5. Limitation of liability for #ABtalks shop

To the maximum extent permitted by law, Bukhash Brothers shall not be liable for any indirect, incidental, or consequential losses, damages, or delays resulting from the use of products purchased through shop.abtalks.ae.

8. Intellectual property

The content available on the Websites, including but not limited to text, graphics, logos, videos, podcasts, and products, is protected by intellectual property laws. Any unauthorized use or reproduction is strictly prohibited. All trademarks and domain names are the exclusive property of Bukhash Brothers and are legally protected.

Nothing in these Terms shall be interpreted as granting any license or right to use any intellectual property of Bukhash Brothers without prior written consent.

9. Data protection and privacy

Both Bukhash Brothers and #ABtalks process personal data in compliance with the UAE Personal Data Protection Law (PDPL).

By accessing or using our services, users consent to the collection and processing of necessary data strictly for the purposes set out in the dedicated Privacy Policy document. Reasonable technical and organizational measures are taken to protect personal data against unauthorized access, alteration, disclosure, or destruction. Clients must ensure that any personal data they provide to Bukhash Brothers and/or #ABtalks has been lawfully obtained and that its transfer to us complies with all applicable data protection laws.

For comprehensive details regarding the collection, use, storage, and protection of personal data, users are required to consult the Privacy Policy, which operates in conjunction with these Terms and Conditions.

10. Confidentiality

Both Bukhash Brothers and its clients shall maintain the confidentiality of all non-public information shared during engagements. This obligation survives termination, except where disclosure is required under UAE law.

11. Limitation of liability

Bukhash Brothers provides its services and content with professional care but does not guarantee any specific outcome. To the fullest extent permitted by law, Bukhash Brothers’ liability is limited to the total fees paid for the relevant services or, in the case of products, to the value of the purchased product.

Bukhash Brothers shall not be held liable for any indirect, incidental, or consequential damages, or for any failures arising from third-party providers, force majeure events, or user negligence.

12. Termination

Bukhash Brothers may terminate services or cancel orders if clients or users breach these Terms, provide unlawful instructions, or fail to pay. Termination does not release payment obligations for services rendered or costs incurred.

13. Dispute resolution and governing law

These Terms are governed by UAE law. Disputes shall first be attempted amicably, failing which they shall be referred exclusively to the competent courts of Dubai, unless otherwise specified in a service or purchase agreement.

14. General provisions

Bukhash Brothers reserves the right to amend, update, or modify these Terms at any time, at its sole discretion, without prior notice. Any such modifications shall become effective immediately upon their publication on the relevant website.

By continuing to access or use the Websites or any of our platforms after such modifications are posted, you confirm your acceptance of, and agreement to be bound by, the updated.

If any provision of these Terms is found to be invalid, unenforceable, or declared null by a competent authority, such provision shall be replaced by a valid provision that most closely reflects the intent of the original clause, without affecting the validity and enforceability of the remaining Terms. These Terms are made available in English. In the event of any discrepancy between the English version and any translation, the English version shall prevail.
